Inquiry and project information is kept only for as long as reasonably necessary to respond, provide services, maintain business records, resolve disputes, enforce agreements, or comply with legal and tax obligations. When it is no longer needed, it will be deleted or anonymized where reasonably practical.

No online service can guarantee absolute security. I use reasonable administrative and technical measures appropriate to the nature of the information, but you should avoid sending passwords, payment-card numbers, government identifiers, or other highly sensitive information through a general contact form.

Intellectual Property Rights

Unless a written project agreement states otherwise, the website, its original text, visual direction, layout, code, reusable systems, and original 3D or UI/UX concepts are owned by Moksh Singh Thakur or the relevant rights holder. Third-party fonts, libraries, stock assets, trademarks, and other materials remain subject to their own licenses.

For paid client work, ownership or license rights in final custom deliverables will be defined in the written proposal or agreement and may depend on full payment. Reusable frameworks, templates, methods, tools, pre-existing materials, and general know-how are not transferred unless the agreement expressly says so.

Unless a client agreement requires confidentiality or says otherwise, I may display completed work, screenshots, descriptions, and a client name or logo in my portfolio, social profiles, proposals, and marketing materials. I will not intentionally publish confidential or unreleased material that I have agreed to keep private.

Disclaimer & Limitation of Liability

This website is provided for general information and portfolio purposes. Information may contain errors, become outdated, or change without notice. The website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

To the fullest extent permitted by law, Moksh Singh Thakur will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, loss of profits, loss of data, business interruption, or reliance on website content. Nothing in this Policy or the Terms excludes liability that cannot legally be excluded, including liability for fraud or applicable consumer rights.

Acceptance and scope

These Terms apply to your use of this website and to design, copywriting, web development, UI/UX, creative development, or related services provided by Moksh Singh Thakur. A project proposal, statement of work, or separate written agreement may add to or replace these Terms for that project.

Project proposals, fees, and expenses

Work begins after the scope, deliverables, timeline, fee structure, payment schedule, and responsibilities are agreed in writing. Prices are estimates or starting points unless expressly identified as fixed. Hosting, domains, paid tools, third-party services, payment fees, revisions beyond the agreed scope, and applicable taxes may be charged separately.

Client responsibilities

You are responsible for providing accurate content, approvals, brand assets, access, feedback, and rights to materials you supply. Delays in receiving required information or approvals may change the delivery timeline. You must not ask me to use content or materials in a way that infringes another person’s rights or violates applicable law.

Revisions, delivery, and acceptance

Included revisions and delivery milestones are defined in the applicable project agreement. New features, new pages, major changes in direction, or work outside the agreed scope may require a revised estimate. A deliverable is considered accepted when approved in writing or used publicly, subject to any express review period in the agreement.

Payment, cancellation, and termination

Invoices are due according to the agreed schedule. Work may pause if an invoice is overdue. If a project is cancelled, you remain responsible for approved work performed, committed expenses, and any non-refundable amounts stated in the agreement. Either party may terminate for a material breach that is not cured within a reasonable written notice period.

Third-party services and hosting

Websites may rely on services outside my control, including hosting, domains, email, analytics, APIs, plugins, AI tools, and payment providers. Their availability, pricing, policies, and technical behavior may change. I am not responsible for outages, changes, suspension, or failures caused by those providers, except to the extent a written agreement expressly says otherwise.

Confidentiality

Each party should protect non-public information received from the other and use it only for the project. Confidentiality does not apply to information that is public, independently developed, already known without an obligation of confidentiality, or required to be disclosed by law.

Warranties

I will perform agreed services with reasonable care and skill. Unless a written agreement says otherwise, no promise is made that a website will be uninterrupted, error-free, rank in search engines, achieve a particular business result, or work with every third-party service, browser, device, or future platform update.

Governing law

These Terms are intended to be interpreted under the laws applicable in the jurisdiction where Moksh Singh Thakur primarily operates, subject to any mandatory consumer or data-protection laws that apply to you.
